License Agreement (EULA)
End User License Agreement for the CALinONE application on Apple devices.
1. Acknowledgement
This End User License Agreement ("License", "EULA") governs your use of the CALinONE application ("the Licensed Application", "the App") on Apple-branded devices. It is a legal agreement between you ("the End-User") and Igeling ("the Developer", Niklas Braune, Fombachstraße 14, 34513 Waldeck, Germany) only, and not with Apple Inc. ("Apple").
The Developer, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA may not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions; in the event of any conflict, the Apple Media Services Terms and Conditions prevail.
By downloading, installing, or using the App, you agree to be bound by this License. If you do not agree, do not download, install, or use the App.
2. Scope of the License
The Developer grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Except as expressly permitted in this License or by mandatory applicable law, you may not copy, modify, distribute, sell, rent, sublicense, or create derivative works of the App, nor reverse-engineer, decompile, or disassemble it. The name "CALinONE", the logo, and all related trademarks, as well as the App's design, code, and graphics, remain the intellectual property of the Developer.
3. Data and Privacy
CALinONE stores all of your data locally on your device and does not require a user account. The Developer does not collect or have access to your personal data, with the sole exception of the optional, end-to-end-encrypted "Share calendar" feature, in which Google Firebase relays encrypted content that neither Google nor the Developer can read. How data is handled is described in full in our Privacy Policy. By using the App you also accept our Terms of Service, which apply in addition to this License.
4. Maintenance and Support
The Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

5. Warranty
The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The App is otherwise provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by applicable law.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Developer.
6. Product Claims
You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This License does not limit the Developer's liability to you beyond what is permitted by applicable law.
7. Intellectual Property Rights
You and the Developer acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
8. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You further agree that you will not use the Licensed Application for any purposes prohibited by applicable law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

10. Third Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, if you use the optional Google Calendar integration or the "Share calendar" feature, you must comply with Google's applicable terms of service; if you use the Home Assistant integration, you must comply with the terms applicable to your Home Assistant instance; and you must not be in violation of your wireless data service agreement when using the App.
11. Third Party Beneficiary
You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
12. Governing Law
This License is governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer protection provisions of the country in which you have your habitual residence. This does not affect Apple's rights as a third-party beneficiary under Section 11.
